Hearthwood Designs LLC ("we," "our," or "us") provides branding and web design services, including but not limited to website design, branding (logos, business cards, etc.), and website hosting and maintenance. These Terms apply to all clients, visitors, and users of our services.

2. Services Provided

Hearthwood Designs LLC offers the following services:

    • Website design and development
    • Branding and graphic design (logos, business cards, typography recommendations, etc.)
    • Website hosting and maintenance (if applicable)

All services are subject to these Terms, and specific details of a project will be agreed upon in writing (via contract, email, or invoice).

3. Payments & Refunds

    • A deposit may be required before work begins.
    • Full payment must be made before the final delivery of website files, branding materials, or launching a website.
    • Payments are non-refundable once work has started. If a client cancels before work begins, a partial refund may be provided at our discretion.
    • Additional costs (such as third-party services, premium fonts, or stock images) may be charged separately if requested by the client.

4. Project Timeline & Revisions

    • Estimated project timelines are based on client responsiveness. Delays in providing content, approvals, or feedback may extend the timeline.
    • Each project includes a set number of revision rounds as outlined in the agreement. Additional revisions may incur extra charges.

5. Client Responsibilities

Clients agree to:

    • Provide necessary content, images, and branding materials in a timely manner.
    • Ensure they have the legal right to use any images, text, or assets provided to us.
    • Review and approve designs before finalization.
    • Maintain up-to-date website security if not enrolled in a maintenance plan.

6. Intellectual Property & Ownership

    • Clients will own the final website, logo, or branding materials upon full payment.
    • Hearthwood Designs LLC retains the right to display the work in our portfolio unless agreed otherwise.
    • Any stock images, fonts, or third-party assets remain subject to their original licenses and may require additional licensing fees.

7. Website Hosting & Maintenance (If Applicable)

    • Hearthwood Designs LLC offers hosting services as an optional service. While we strive for maximum uptime, we do not guarantee uninterrupted service.
    • We are not liable for any data loss, downtime, or security breaches. Clients are encouraged to back up their data regularly.
    • Clients are responsible for renewing their domain name separately unless included in a managed plan.

8. Limitation of Liability

Hearthwood Designs LLC is not responsible for:

    • Any business losses, lost revenue, or damages resulting from website downtime, security issues, or errors.
    • Issues caused by third-party services, hosting providers, or software updates.
    • Clients using their website or branding in violation of laws or regulations.

9. Termination of Services

Hearthwood Designs LLC reserves the right to refuse or terminate services under the following conditions:

    • Failure to make required payments.
    • Client behavior that is abusive, threatening, or unreasonable.
    • Projects that violate ethical or legal guidelines.

10. Changes to These Terms

We may update these Terms from time to time. Continued use of our services after any updates constitutes acceptance of the new Terms.
